IDEA Cellular Ltd offers "IDEA GOLD COIN CONTEST" subject to the following Terms and Conditions mentioned below (hereinafter referred as "Terms").
THIS OFFER IS OPEN ONLY TO SPECIFIED PRE-PAID SUBSCRIBER WHO RECEIVE A SHORT SERVICE MESSAGE FROM IDEA CELLULAR LTD INVITING THEM TO PRATICIPATE IN THE OFFER AND WHO SATISFY THE ELIGIBILITY CRITERIA.  PRE-PAID SUBSCRIBER/S IS/ARE ADVISED TO ASCERTAIN THE ELIGIBILITY CRITERIA BEFORE PARTICIPATING IN THE OFFER.

PLEASE READ THESE TERMS CAREFULLY BEFORE PARTICIPATING IN THIS OFFER KNOWN AS "IDEA GOLD COIN CONTEST". BY PROCEEDING WITH REGISTRATION AND BY PARTICIPATING IN THE OFFER "IDEA GOLD COIN CONTEST", YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.  IF YOU DO NOT AGREE TO THE TERMS, OR IF YOU HAVE NOT RECEIVED THE INVITATION SHORT SERVICE MESSAGE REGARDING THE OFFER FROM IDEA CELLULAR LTD OR IF YOU DO NOT SATISFY THE ELIGIBLE CRITERIA, PLEASE DO NOT PARTICIPATE IN THE OFFER "IDEA GOLD COIN CONTEST".

TERMS:

This offer "IDEA GOLD COIN CONTEST" (hereinafter referred to as "Offer") is sponsored and organized by IDEA Cellular Limited, a company having its registered office at Suman Tower, Plot No. 18, Sector - 11, Gandhinagar - 382 011 and Corporate Office at 5th Floor, Windsor, Off CST Road, Kalina, Santacruz (E), Mumbai - 400098 (hereinafter referred to "IDEA") through its Circle office IDEA Cellular Ltd, 3rd Floor, K L K Estate, Fateh Maidan Road, Basheerbagh, Hyderabad 500 001.
ELIGIBILITY CRITERIA FOR PARTICIPATING IN THE OFFER.
General Criteria

  1. The "IDEA GOLD COIN CONTEST" is a limited period offer.
  2. The Offer will be open from (00:00 hrs of 26th January, 2010 to 23:59 hrs of 24th  February, 2010).
  3. The Offer is open for participation only for the existing active Pre-paid Subscribers of IDEA Cellular Limited in Andhra Pradesh Telecom Circle and those Pre-paid Subscribers who have received a Short Service Messaging (SMS) inviting them to participate in the Offer.
  4. IDEA shall reserve the right to offer an invitation for participation.
  5. IDEA shall reserve the right to select the base of Pre-paid Subscriber/s who shall be eligible for participating in the Offer.
  6. The Base of Pre-paid Subscriber/s who shall be eligible for participating in the Offer shall be selected on the basis of Usage Summary of such Pre-paid Subscriber/s during the month of December 2009/January 2010.
  7. The Offer is open for participation only for the existing active Pre-paid Subscribers of IDEA Cellular Limited in Andhra Pradesh Telecom Circle. The Offer is not applicable to Roaming Pre-paid Subscriber/s* (Pre-paid Subscriber/s who are visiting Andhra Pradesh Telecom Circle from other Telecom Circles and who do not belong to Andhra Pradesh Telecom Circle) however; Pre-paid Subscribers  belong to Andhra Pradesh Telecom Circle on roaming can however participate in the offer.  
  8. This Offer is valid only for existing category of active Pre-paid Subscriber who fulfills the following criteria: (Participant or Pre-paid Subscriber where ever used in the terms and conditions shall mean and refer to "Subscriber/Participant/ You").
    • The participant must be above 18 years of age. 
    • The participant must be a citizen of India
    • The participant must not have been either prosecuted or convicted for commission of any   criminal offence;
    • The participant must not be suffering from any legal disability e.g. insolvency, restraint by Court Order etc.
    • *TThe subscriber/Participant shall mean the rightful owner/user of the mobile connection and a person/individual in whose name the mobile phone number is registered as per the records maintained by IDEA Cellular Ltd (and which shall be conclusive), or in case of an employee who is the user of the phone registered in the name of an employing company, provided that the employing company issues a letter that the employee has been allotted the specific mobile phone number. Further, the winner will be the rightful owner/user of the winning mobile phone number (which is registered as per the records maintained by IDEA Cellular Ltd (and which shall be conclusive), and not the player, if such player is not the rightful owner/user of such mobile number. If the winner is not able to provide sufficient evidence to show that he/she is the rightful owner/user of the mobile, IDEA reserves the right to award the pass to the next eligible winner. 
Winner Selection

Eligibility Criteria

  1. The Base of Pre-paid Subscriber/s who shall be eligible for participating in the Offer shall be selected on the basis of SMS Usage of such Pre-paid Subscriber/s during the month of December 2009/January 2010.
  2. A Participant Subscriber whose SMS usage is nil and falls under the "SMS Zero Usage Category", and who makes a minimum usage of 5 SMS's and also be a Participant Subscriber with a highest SMS Usage during the Offer Period i.e. from (00:00 hrs of 26th January, 2010 to 23:59 hrs of 24th  February, 2010) shall win one Gold Coin worth of Rs.5,000/-.
  3. A Participant Subscriber whose SMS usage between 1 to 5 SMS's and falls under the "Minimal Usage Category", and who makes a minimum usage of 10 SMS's and also be a Participant Subscriber with a highest SMS Usage during the Offer Period i.e. from (00:00 hrs of 26th January, 2010 to 23:59 hrs of 24th  February, 2010) shall win one Gold Coin worth of Rs.5,000/-.
  4. A Participant Subscriber whose SMS usage between 6 to 20 SMS's and falls under the "Medium Usage Category, and who makes a minimum usage of 30 SMS's and also be a Participant Subscriber with a highest SMS Usage during the Offer Period i.e. from (00:00 hrs of 26th January, 2010 to 23:59 hrs of 24th  February, 2010) shall win one Gold Coin worth of Rs.5,000/-.
    SMS Usage During the Offer Period i.e. from (00:00 hrs of 28th January, 2010 to 23:59 hrs of 28th February, 2010)
    0 A Participant Subscriber who makes a minimum usage of 5 SMS's and also be a Participant Subscriber with a highest SMS Usage shall win one Gold Coin worth of Rs.5,000/-.
    1-5 A Participant Subscriber who makes a minimum usage of 10 SMS's and also be a Participant Subscriber with a highest SMS Usage shall win one Gold Coin worth of Rs.5,000/-.
    6-20 A Participant Subscriber who makes a minimum usage of 30 SMS's and also be a Participant Subscriber with a highest SMS Usage shall win one Gold Coin worth of Rs.5,000/-.

 

Pre-paid Subscriber/s using Value Vouchers*(VV)* for SMS usage are also eligible to participate. Value Vouchers*(VV)* means any recharge voucher that gives SMS usage benefit.

In the event of a tie between two or more participant/s or Pre-paid Subscriber/s, in the Eligibility Criteria, then the participant/ Pre-paid Subscriber/s shall be selected based on random search using MS EXCEL 2003 command as follows;

RAND BETWEEN (1, N)
"N" is number of participant/ Pre-paid Subscribers in each of in the above Eligibility Criteria. All participant/ Pre-paid Subscribers (represented by their IDEA Mobile Subscriber Number) will be assigned a serial number between 1 to N (including N). The first IDEA Mobile Subscriber Number on each segment picked on running the command shall be the participant/ Pre-paid Subscribers to for winning the Gold Coins under the Offer. If total participant/ Pre-paid Subscribers are more than 50,000, then serial number will be generated using MS ACCESS 2003.
Other Conditions
bullet This Offer is being made purely on a "best effort" basis and participation of eligible subscriber/s is voluntary
bullet The maximum number of Three (3) Gold Coins that shall be delivered under this offer to the eligible participant/ Pre-paid Subscriber/s.
bullet The Subscriber shall directly contact IDEA Customer Care for any queries / complaints
bullet The Subscriber hereby understands and gives his/ her irrevocable consent to IDEA to deal with personal information relating to the Subscriber and to exchange with or publish and/or communicate to/in any media (Electronic (includes Television and Radio)/Web/Print) that they may deem fit, and IDEA may, at their sole discretion may choose to publish or disclose the name(s), and phone number(s) if required, and specifically, of winners
bullet A eligible participant/ Pre-paid Subscribers by participating in the Offer hereby agrees to these terms and conditions of the Offer and gives his/her consent to the winner selection process as set out, and any appropriate changes that may be made to this Offer due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Organizers, their affiliates and associates.
bullet Acceptance of the Gold Coins by the winner constitutes permission for IDEA and its affiliates to click photographs of the Winner/s and use the Winner's name, photographs, preferences (likes and dislikes), voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever
bullet The winners list shall be published after the end of the offer at http://idea.contestzone.in and www.ideacellular.com. The subscriber(s) can log into the aforementioned address to check if he/she has won the Gold Coin from 7th March 2010.
bullet The winners shall be informed by SMS, and shall be required to contact the number as shall be specified in the SMS within 2 days of receipt of the SMS, to enable them to claim the Gold Coin. In the event that winner(s) do not revert pursuant to receipt of the SMS, IDEA shall once again try to contact the winner(s) by SMS/Telecall, or in such other manner as it shall deem fit. If the winner(s) still cannot be contacted within the time frame set out in such communication, and /or the verification of the identity of the winner(s) is not possible due to any reason(s), then the IDEA reserves the right to issue the Gold Coin to the next eligible winner.
bullet IDEA may to its best ability inform the winners by calling them on their Mobile or Telephone Numbers as per the records maintained by it. The Gold Coins must be claimed by the winners, along with the specified documents and at the specified venue i.e. IDEA Cellular Ltd, 3rd Floor, K L K Estate, Fateh Maidan Road, Basheerbagh, Hyderabad 500 001. The documents required to be submitted along with the claim by the winner include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):
    • Identity Proof
    • Address Proof
    • Proof of holding the IDEA mobile subscription connection
bullet All incidental costs/(taxes/levies if any)/travel costs incurred by the winner/s for claiming the Gold Coins, shall be exclusively borne by the subscriber/winner/s. In no event IDEA shall not be responsible for any of the costs incurred by the participant/ Pre-paid Subscribers for participating in the Offer
bullet The Gold Coins under the Offer is neither assignable nor transferable under any circumstances
bullet The Gold Coins to the winner/s shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the offer and on production all such documents/papers as required by IDEA before accepting the delivery of the Gold Coins. Any failure on the part of the winner to comply with directions issued by IDEA for claiming the Gold Coin shall entitle IDEA to issue the Gold Coin to the next eligible winner
bullet The employees of IDEA or of their group companies, affiliate or associate companies shall not be eligible to participate in this Offer
bullet This Offer cannot be used in conjunction with any alternative offer or promotion
bullet This Offer is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of the IDEA
bullet All participant/ Pre-paid Subscribers who have won the Gold Coins (including those participants if any from towns/villages outside Hyderabad) have to make their own arrangements for travel, accommodation to claim the same; IDEA Cellular Ltd is not responsible for the same or any cost incurred by any of them
bullet IDEA shall be responsible for any claims arising out of technical failures before or during or after the completion of the Offer including but not limited to any technical failures in the telephone lines, failure due to cellular network connectivity or coverage/ failure due to cellular network congestion, failure of servers or the failure to provide the details of the winner/s or any mistakes arising out of technical snags
bullet The participant/ Pre-paid Subscriber/s hereby agrees and undertakes not to hold IDEA and/or or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that the participant/ Pre-paid Subscriber/s may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of the present Offer and/or in default in the performance of their obligations and as long as such performance is prevented, hindered or delayed for reasons of  any technical/system failures beyond the reasonable control of IDEA Cellular Limited or by such act of God, as severe earthquake, typhoon or cyclone (except monsoon) floods, lightning, landslide, fire, explosions, plague or epidemics, strike and lockouts, sabotage, blockade, war, riots, invasion, act of foreign enemies, hostilities, rebellion, revolution, insurrection/or military usurped power or confiscation or trade embargoes or destruction or requisition by order of any Government or any public authority
bullet IDEA shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), to a participant/ Pre-paid Subscriber/s and/or any third party, directly or indirectly, during the participation or during the claiming of Gold Coins
bullet Participant/ Pre-paid Subscriber/s hereby agrees and undertakes not to hold IDEA and/or or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that he/she may/might have suffered, sustained or incurred, or claims to suffer, sustain or incur, by way of and /or on account of the present Offer
bullet IDEA reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer/contest or any part thereof including the eligibility criteria, the Terms & Conditions and Gold Coins at their sole discretion at anytime during it's validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Participant/ Pre-paid Subscriber/s
bullet IDEA and the Participant/ Pre-paid Subscriber/s assume liability for, and shall defend, indemnify and keep harmless the other party's officers, directors, employees, successors and assigns and the defaulting party ("Indemnifying Party") shall indemnify the non defaulting party("Indemnified Party") from and against any and all liabilities, obligations, losses, damages, penalties, claims, demands, actions, suits, costs and expenses (including, without limitation, reasonable legal fees and expenses), arising from claims of third parties/subscriber/s or other wise or from any government or statutory bodies, of whatsoever kind or nature, imposed on, incurred by or asserted against the parties, resulting from, arising out of, or incurred with respect to (i) the breach of any covenant or warranty or representation, or a material breach of this terms and conditions, or (ii) the performance of the services, (iii) infringement of the  (intellectual property rights), title, and interest in all Copyrights, Artistic Works, Logos, Trade Dress, Service Marks, Trade Marks, Trade Names, etc (however, that parties shall not be required under this clause to defend, indemnify or keep harmless any Indemnified Party for loss or liability resulting from any negligence, willful misconduct or gross negligence of such Indemnified Party)
bullet Approvals: IDEA and the Participant/ Pre-paid Subscriber/s agree that at all times and at their own expense to (i) obtain requisite approvals and licenses and strictly comply with all applicable laws, rules, regulations, Governmental orders and applicable codes of practice, now or hereafter in effect, relating to its performance of this Terms and Conditions, (ii) pay all fees and other charges required by such laws, rules and regulations, codes and orders; and (iii) maintain in full force and effect all licenses, permits, authorizations, registration and qualifications necessary to perform its obligations under this Terms and Conditions. In the event, a Party fails to obtain any such approvals, licenses and permits or is in non-compliance with such laws, rules, regulations, Governmental orders and applicable codes of practice or commits any default under such approvals, licenses and permits, and if non-defaulting Party/ies suffers any loss, damage or any prejudice whatsoever due to such failure, non-compliance or default, the Party at Default shall be liable to indemnify and hold the non-defaulting Party/ies harmless from all such losses, damage and prejudice suffered by it/them including but not limited to providing legal counsel at the expense
bullet Unless the context clearly requires otherwise, (a) "shall," "will," and "agrees" are mandatory and "may" is permissive; (b) "or" is not exclusive; and (c) "includes" and "including" are not limiting. The singular includes the plural and vice versa and words importing a gender includes other genders
bullet The terms and conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form/Customer Application Form. The IDEA and the Participant/ Pre-paid Subscriber/s shall be bound by the terms and conditions of Subscriber Enrolment Form/Customer Application Form regarding the use of mobile cellular services offered by IDEA
bullet The Terms and Conditions are subject to Laws of India and to the exclusive jurisdiction of the Courts in Hyderabad/Secunderabad
