Terms and Conditions of the Offer for participants

IDEA FILMFARE CONTEST

PLEASE READ THESE TERMS CAREFULLY BEFORE REGISTERING TO PARTICIPATE IN THIS CONTEST KNOWN AS "IDEA FILMFARE CONTEST". BY PROCEEDING WITH REGISTRATION AND USE OF IDEA FILMFARE CONTEST, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT PARTICIPATE IN IDEA FILMFARE CONTEST.

TERMS:

This contest is hosted by OnMobile Global Ltd., a company having its office at No 26, Bannerghatta Road, J.P. Nagar 3rd phase, Bangalore - 560076 ("OnMobile") in association with Idea Cellular Limited, a company having its registered office at Suman Tower, Plot No. 18, Sector - 11, Gandhinagar - 382 011 and Corporate Office at 5th Floor, Windsor, Off CST Road, Kalina, Santacruz (E), Mumbai-400098 (hereinafter referred to as "Idea") (jointly referred to as 'Organizers')and the contest is open for a limited period from 16th February 2010 00:00:01 hrs till 15th March 2010 23:59:59 hrs for the pre-paid as well as post-paid category of cellular subscribers* of the Idea FilmFare Pack(open for subscription from 16th February 2010 till 11th March 2010), of all Idea Cellular Limited telecom circles as set out in schedule 1 herein below. Once the subscriber has subscribed to the Pack, he/she will be allowed to participate in the Contest. The contest is also available to Roaming subscribers.

A Subscriber, by participating in the Contest, hereby agrees to these terms and conditions mentioned below and gives his/her consent to the winner selection process as set out herein, and any appropriate changes that may be made to this Contest by the organizers or due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of Idea, its affiliates and associates.

Also, by participating in this contest, you:

Warrant that you have read, understood and agreed to conform to these Terms and Conditions.
Warrant the accuracy, truthfulness and currency of all information that you have submitted.

By participating in the Contest, you indicate your acknowledgement and acceptance of these terms and conditions

Procedure and Eligibility to participate

This contest is valid for all active Prepaid and Postpaid Idea Subscribers* who fulfill the following criteria:

Subscriber must be above 18 years of age.
Subscriber must be a citizen of India.
Subscriber must not be convicted and/or prosecuted for the commission of any criminal offence.
Subscriber must not be under any legal disability.

*The subscriber, the rightful user of the connection, is a person in whose name the mobile phone number is registered, or the employee, who is the user of the phone, if the phone is registered in the name of a company, provided that company issues a letter stating that the employee has been allotted the specific phone number.
Further, the winner will be the subscriber of the winning mobile phone number and not the player, if such player is not the rightful user of such mobile number. If the winner is not able to provide sufficient evidence to show that he/she is the subscriber of the mobile number, OnMobile/Idea reserves the right to award the prize to the next eligible winner, or forfeit the prize, at their sole discretion.

To Participate

The subscribers can subscribe to the Idea FilmFare Pack @Rs.30 by :

Sending SMS IFF to the toll-free number-55456340
By pressing 1 through OBDs
By registering in the Idea website- www.ideacellular.com
By dialing the USSD String *333*07#

The user, once subscribed to the pack, can play the Contest by sending the keyword 'FFC' to the toll-free number 55456340.
- A welcome message will be sent to the participant for the first time he/she sends the keyword, giving him/her the rules, gratification & T&C URL, followed by the first question and answer options.
- To answer, participants have to SMS FFC A/B to 55456340.
- For every right answer the participant will get 1 point. There is no negative marking for a wrong answer.
- After every right answer the participant will receive an SMS saying Right, with his/her score followed by the next question and answer options.
- After every wrong answer, the participant will be told that the answer is wrong, with his/her score, and will be given the next question and answer options.
- If the participant stops playing the contest after answering the nth question, then when he/she sends the keyword again, he will get the (n+1)th question.
- If the participant stops playing the contest without answering the nth question, then when he/she sends the keyword again, he will get the same question.
- The contest consists of 10 questions based on Bollywood movies.
- Once the participant completes the Contest, he/she will receive an SMS with his/her score and will be informed that if he/she is a winner, he/she will be contacted.
- Once the participant completes the questions, he / she cannot play the contest again.
- If the participant unsubscribes from the Filmfare pack without completing the contest, when he/she subscribes again, he/she can continue playing the contest from where he/she left off. For example: if the participant unsubscribes from the pack after having answered 5 questions and has scored 4 points, when he/she subscribes to the pack again, on sending the keyword FFC to 55456340, he/she will receive the 6th question, and will resume the contest with a score of 4 points.
A subscriber can unsubscribe from the FilmFare pack by sending UNSUBIFF to 55456 at Rs 3 per SMS, or to the tollfree number 55456340.
All the subscribers of the pack will also get free access to content like wallpapers, film trivia, etc. as shall be communicated to the subscribers by Idea.

In the event that the user unsubscribes from the pack at any time during its validity, he/she will not be allowed to participate in the contest. He/she will also not be allowed access to any of the above mentioned content once he/she has unsubscribed.

Also, if the user subscribes to the FilmFare pack more than once, i.e. if he/she unsubscribes and then subscribes again, he/she will be charged a subscription fee of Rs 30/- every time he/she subscribes to the packmount) till 23rd February 2010 (00:00 hrs) & share the same with corporate team latest by 25th February afternoon

Prizes

Mid Contest Prize- 2 top scorers as on 23rd Feb 2010 23:59:59 hrs will each win a couples'* pass to the 55th FilmFare Awards ceremony, and an i-Pod worth Rs 3550/-. The Awards ceremony will be held in Mumbai on 27th Feb 2010. All Travel, stay, food, or any other such expenses that may be incurred by the winner on account of this prize, shall be borne solely by the winner.
Bumper Prize- 5 highest scorers at the end of the contest will each win an i-Pod worth Rs 3550/-.
2nd Prize- The next 7 highest scorers at the end of the contest will each win a gift Voucher worth Rs 2000/-.

*Couple- the winner can take any person s/he wants to, along with her/him, provided such person possesses all necessary documentation. He/she does not necessarily have to be a spouse or a family member of the winner.

4. Winner selection:

The winner selection for the mid contest prize will be done on the 24th of Feb 2010. Two highest scorers as on 23rd Feb 2010 23:59:59 hours, will be selected as the winners of the above mentioned mid contest prize. The winners of this prize will not be eligible to win any one of the remaining prizes being offered in this contest.
The winner selection for the Bumper Prize and the 2nd prize will be conducted at the end of the contest.
5 highest scorers, at the end of the contest, will win the Bumper Prize of an i-Pod worth Rs 3550/-, each. The winners of this prize are then removed from the list of eligible winners of the 2nd prize.
The next 7 highest scorers, at the end of the contest, will be selected as the winners of the 2nd prize of a Gift Voucher worth Rs 2000/- each.

At any point during the winner selection of any of the above mentioned prizes, in case of a tie in the highest score, the participant to have achieved the score by utilizing the least number of questions will be selected as the winner. In the event of a further tie in the number of questions utilized, the winner will be selected through a system generated random selection process which will be scrutinized by an independent audit mechanism.

The prize of the couples passes will be sponsored and arranged by Idea. The prizes of the I-pods and the Gift Vouchers will be sponsored by OnMobile.

The selected eligible winners of the passes to the 55th FilmFare Awards shall be informed by SMS between 24th and 25th Feb 2010 about the procedure to collect the prizes by Idea, within teo days. In the event that the subscriber does not revert pursuant to the receipt of the SMS, Idea shall once again try to contact the subscriber by Telecall, in such manner it shall deem fit. If the subscriber still cannot be contacted within the time frame set out in such communication, and/or the verification of the identity of the subscriber is not possible due to any reason(s), Idea reserves the right to forfeit the prize at its sole and absolute discretion.

NOTE: The winners of the passes to the FilmFare Awards shall be required to be dressed in Formals.
Also, the i-Pods that will be given away as part of the Mid-Contest prize will be distributed after the end of the contest. Further details regarding when and where the winners can collect the i-Pods will be communicated to the winners after the end of the contest.

The winners of the Bumper Prize and the 2nd Prize will be contacted after the end of the contest, and will be given further details of how they can avail their prize. The prizes must be claimed by the winners within one month of the date of intimation, failing which, the prize will be forfeited. In the event that any of the winners cannot be reached or are ineligible or are disqualified, for any reason whatsoever, the organizers reserve the right to forfeit the prize or roll the prize over to the next eligible winner, at their sole discretion.

If the winner of the passes to the 55th FilmFare Awards confirms claim to the prize (agrees to travel to the venue of the event) on a said date but fails to make it to the venue as specified by the organizers, the winner shall forfeit his/her prize.

This Offer is being made purely on a "best effort" basis and participation of eligible subscribers is voluntary, and subject to acceptance of these terms and conditions.

By entering the contest, you confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and you agree to receive promotional messages from the organizers, as they may in their sole and absolute discretion decide.

Subscriber shall directly contact OnMobile regarding any queries / complaints pertaining to the contest. Alternatively, the subscriber can send an email to contests_cc@onmobile.com. All disputes must be addressed by the Subscriber in writing to OnMobile directly and IDEA shall not entertain any communication in this regard.

The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the Subscriber to be exchanged with Idea, OnMobile and its vendors or published and/or communicated to/in any media that it may deem fit, and Idea, OnMobile or its Vendors may, at their sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of all participants, if required, and specifically, of winners.

You acknowledge and agree that all copyright and trade marks and all other intellectual property rights in the SMS content/ WAP/ website and all material or content related to the Contest shall remain, at all times, owned by OnMobile/ the Organizers / their respective owners. All material and content contained in this website is made available for your personal and non-commercial use only. Any other use of the material/ content on this website/WAP site and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.

Idea/OnMobile is neither responsible nor guarantees the quality of the goods/ services being offered as prizes nor is it liable for any defect or deficiency of goods or services so obtained/availed, by the subscribers under this Offer. OnMobile is also not liable for any defect/ deficiency in the prize(s) so offered or availed, by the subscribers under this Offer.

The prize(s) under the Offer is neither assignable nor transferable under any circumstances. All the prizes shall be subject to such other terms and conditions as may be applicable to specific prizes and shall have to be duly complied with by the winner.

The prize(s) to the winner shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the prize(s) and on production of all such documents/papers as may be required by Idea/OnMobile before accepting the delivery of the prize. Any failure on the part of the winner to comply with directions issued by Idea/OnMobile for claim of prize shall entitle Idea/OnMobile to forfeit or roll-over the prize(s).

A subscriber shall be considered ineligible if he/she does not conform to the conditions as stipulated in these terms and conditions, or cannot provide any of the required documents as stipulated in clause 19 herein below.

The Organizers, at their sole discretion, may or may not provide a cash alternative to the gift vouchers being offered in this contest.

All incidental costs/taxes/levies related to the prize(s), if any, shall be exclusively borne by the subscriber and any other taxes applicable by the Central, State or Municipal government.

All prizes must be claimed by the winner, along with the documents specified herein below. The documents required to be submitted along with the claim by the winner include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of Law):

Address Proof
Proof of holding the Idea telephone connection
Letter of Compliance with rules and regulations and declarations in the format as may be required by Idea etc

Any prize of value in excess of INR Rs. 5,000/- will attract deduction of tax at source and all taxes to be paid on the prize/s shall be paid by the winner on the prevailing rate.

The winners list shall be published after the end of the contest at http://idea.contestzone.in.

The employees of Idea / OnMobile and their group companies, affiliate or associate companies shall not be eligible to participate in this Offer.

The Prizes shall be handed over by Idea/OnMobile on receipt of all the documents, from the winner, required to process the distribution of the Prize.

This Offer cannot be used in conjunction with any alternative offer or promotion.

This Offer is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Idea/ OnMobile.

The terms and conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form.

This Offer is subject to guidelines/ directions issued by the Telecom Regulatory Authority of India or any other statutory authority from time to time.

The decision of Idea and OnMobile in respect of all transactions under this offer shall be final and binding.

Neither Idea nor OnMobile shall be responsible for any claims arising out of technical failures before, during or after the completion of the Contest including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct Contest score updates or any mistakes arising out of technical snags. Further, OnMobile/Idea shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of OnMobile or Idea.

The subscriber hereby agrees and undertakes not to hold Idea/ OnMobile and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or remote that you may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of this Contest.

Idea/OnMobile or any of their group entities or affiliates, their respective directors, officers, employees, agents, representatives, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), by a participant and/or any third party, directly or indirectly, by use or non-use of the prizes offered in this contest.

Idea/OnMobile reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer/contest or any part thereof including the eligibility criteria, the Terms & Conditions and prizes at their sole discretion at anytime during it's validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these terms and conditions.

These Terms & Conditions are subject to Indian Law and the exclusive jurisdiction of the Courts in Bangalore.
